California and Delaware Attorneys-General Raise Safety Concerns

Top state lawyers in California and Delaware have written to OpenAI expressing “serious concerns” about the company’s safety practices following reports of deaths linked to its AI chatbots, including ChatGPT. The attorneys-general emphasized that safety improvements are essential before approving OpenAI’s planned restructuring.
In their letter to OpenAI chair Bret Taylor, California Attorney-General Rob Bonta and Delaware Attorney-General Kathy Jennings cited recent tragic incidents, including the suicide of a Californian teenager and a murder-suicide in Connecticut, which occurred after prolonged interactions with AI chatbots. “Whatever safeguards were in place did not work,” they wrote, noting that public confidence in the company has been shaken.
OpenAI, founded in 2015 as a non-profit, is seeking to convert part of its business to allow investors to hold equity, while keeping the non-profit board in control. The attorneys-general play a crucial role in regulating the company and determining whether this restructuring can proceed. Their intervention suggests that even the more limited plan could be blocked if OpenAI cannot demonstrate significant safety improvements.
The company recently announced plans to introduce parental controls for ChatGPT amid ongoing concerns. OpenAI is also facing legal action, including a lawsuit from the family of Adam Raine, a 16-year-old who died by suicide after prolonged use of the chatbot.
The case highlights the broader tension between AI safety and commercialisation. With OpenAI raising billions in funding and facing competition from Anthropic, Meta, Google, and xAI, regulators are scrutinizing the company’s ability to balance growth with public safety.
Bonta and Jennings stressed that “safety is a non-negotiable priority, especially when it comes to children.” Their letter follows a wider warning from 44 state attorneys-general last month, cautioning AI companies that the potential harms of AI could far outweigh even the risks posed by social media, particularly for young users.
As OpenAI navigates this high-stakes landscape, regulatory oversight will likely play a key role in determining how and when the company can expand its commercial operations.
